- In Malaysia, IP Registration is available for form and appearance (design); image and reputation (trade mark); invention (patent).
- No protection for unregistered patent and design.
- Protection for unregistered trade mark is through “passing off” proceeding, which is time-consuming and unpredictable.
- Registration is a prima facie evidence for an owner to claim his exclusive rights to the use of the IP in Malaysia.
- A proprietor is prudent to register with the Government in order to claim exclusive IP rights.
