Available for any PCT application with an International Filing Date on or after 16 August 2006.
The time limit for national phase entry is 30 months from the Earliest Priority Date.

Fraud Email from Lim Chong Associates |

Lately, we received email notification about a Barrister Lim Chong soliciting consent to act as a next-of-kin with regards to a bank account. The Barrister claimed to be from Lim Chong Associates in Kuala Lumpur, Malaysia.
The attachments of the identity card and the lawyer certificate were all false and can be considered illegal.
With this, we wish to advise all of our clients and the public at large to be cautious of such persons and activities.
Your best action will be to immediately ignore such communication.

MALAYSIA USING NICE CLASSIFICATION 9TH EDITION |

Malaysia has become the Contracting Party to Nice Agreement and Vienna Agreement on 25 July 2007. The Agreements entered into force on 28 September 2007.
For applications file on and after 28 September 2007, applicants are required to use the Nice Classification 9th Edition.
As for marks consisting of device/figure, please use Vienna Classification 5th Edition.

INDONESIA CLAIMED OWNERSHIP OF FOLK SONG ‘RASA SAYANG’ |

Malaysia is using the folk song “Rasa Sayang” in its Truly Asia tourism campaign.
Indonesia now claimed the ownership of the folk song as an Indonesian heritage. Indonesia further accused Malaysia of claiming ownership of traditional Indonesian handicrafts like batik and wayang kulit puppets.
Indonesia’s Copyright Council chairman Enteng Tanamal said that suing Malaysia was unlikely to succeed because the song’s author was unknown.
Malaysia’s Culture, Arts and Heritage Minister, Datuk Seri Dr Rais Yatim said Indonesia has no right to claim ownership over the wayang kulit as it was brought by the Hindu ruler Sri Vijaya in the seventh century and the performing art spread to Langkasuka (Kedah), Palembang, Batavia and Temasik. If Indonesia wants to pursue the matter, it will face a dead end and will affect Malaysia-Indonesia relation.

| INTELLECTUAL PROPERTY COURTS TO BE SET UP |

By month end, 21 Intellectual Property (IP) courts – including 15 Sessions Courts, which specifically handle criminal IP cases will be set up in all States. 6 High Courts which will sit as “special designated courts” in Kuala Lumpur, Selangor, Johor, Perak, Sabah and Sarawak.
Cases to be handled by the courts will include those under the Trade Description Act 1972, Patent Act 1983, Copyright Act 1987, and Optical Disc Act 2000.

| PRAYER PAPER FOR BURNING HAD OBTAINED TRADE MARK REGISTRATION |

Mr Lin Hui Ming of Zhu Ge Kong Ming Sdn Bhd warned all imitation of their “prayer paper” products to be withdrawn from the market.
Zhu Ge Kong Ming Sdn Bhd has obtained trade mark registration for the design of its prayer paper, particularly the “Debt Returning Gold” words. He claimed that the power of official prayers had been endowed on all their original products. Therefore, the burning of their prayer paper could help to avoid the unfortunate according to a Chinese belief.

| COPYRIGHTS DISPUTE – PLAYING CHINESE NEW YEAR SONGS IN PUBLIC |

MCA Youth strongly disagreed with the payment of royalty/licensing fee to Phonographic Performance Malaysia Sdn Bhd (PPM) for playing Chinese New Year songs in public. They claimed that the festive mood of Chinese New Year celebration has been curtailed.
Mr Fang Zhen Ping, of MCA Youth claimed that consumers had already paid to purchase the album. There will be double payment if consumers have to pay in order to play the songs in public.
Mr Chen Ye Fu, of PPM claimed that our Copyrights Act explicitly states that playing songs in the public requires payment of broadcasting copyright fees. There are only three exemptions, namely for non-profit activities, education or charity purposes.
Mr He Xiang Zan, Parliamentary Secretary of the Ministry of Domestic Trade and Consumer Affairs, said that the Ministry will have to reconsider amending our Copyrights Act, to include cultural celebration as another exemption, as suggested by MCA Youth.

| MALAYSIA PCT - NATIONAL PHASE |

According to our Malaysian Patent Office, Malaysia is only available for designation during PCT International Phase after 16 August 2006. As such, National Phase entry to Malaysia will only available for the PCT International Applications filed after 16 August 2006 (Malaysia is designated in the applications).
Our Malaysian Patent Office has indicated their fees for the National Phase, but other fees pertaining to the International Phase are yet to be announced.

| IP COURT SETUP TO BRING POSITIVE RESULTS |

Malaysia is set to have its own Intellectual Property Court to hear cases involving IP infringements.
Expected to be set up by late this year, the court will have specialized judges and lawyers to create a more effective judicial system and speed up cases relating to patents, copyrights and trademarks.

Malaysia has become the 131st PCT Contracting State on 16 May 2006. The PCT enters into force on 16 August 2006.

| COPYRIGHT PROTECTION FOR COMPUTER SOFTWARE |

It is very difficult to register a patent for computer software because most computer codes are likely to infringe the IP that is already owned by established foreign software developers.
An alternative way out is to copyright computer software. Software developers can make a statutory declaration on the IP so that it becomes an evidence.
