When you brief us, your brief remains in-house. It is not referred elsewhere. If we have to prepare the patent specification, please provide details of your invention, including drawings or photographs. Please feel free to make an appointment for discussion. 4. At One Glance
There are 3 stages to go through:
1. Application: You secure a Filing Date and an Application Number.
2. Preliminary Examination: Your application will be examined on formalities.
3. Substantive Examination (SE) or Modified SE Request*:
You need to request for this examination within 2 years from the Filing Date. Otherwise, your Application will be deemed to be abandoned.
* A modified SE can only be requested if patent is granted in USA/ EPO/ UK/ Australia/ Japan/ Korea for the same invention. Costs will be incurred in different stages.
Objection
There might be objection in stages 2 and 3. If there is, you have to decide whether to counter the objection or to give up your application.
Grant or Refusal
If your invention passed all 3 stages, the patent will be granted. If your application is refused, you can appeal to the High Court of Malaya.
Renewal
Renewal fees need to be paid after grant, annually. The protection for applications filed on or after 1 August 2001 is 20 years (from the Filing Date).
